Virgil Bowling Media LLC (“VBM,” “VBM LLC,” “we,” “us,” or “our”) respects the privacy of our clients, prospective clients, and website visitors. This Privacy Policy explains how we collect, use, store, and process information in connection with our photography and media services.

This Privacy Policy applies to websites, online services, client portals, galleries, booking systems, and other online services operated by or on behalf of Virgil Bowling Media LLC, including virgilbowlingmedia.com and vbmllc.com.

When a prospective or existing client contacts VBM outside of our online client-management systems, VBM may enter information provided by that person into our client relationship management (“CRM”), booking, invoicing, or other business systems in order to respond to the inquiry or provide requested services.

Marketing Communications

VBM does not guarantee that photographs or other media will be retained indefinitely, and clients should maintain their own copies of delivered media.

Photographs may also be used for VBM’s portfolio, website, social media, advertising, or other promotional purposes when such use is permitted under the applicable agreement, release, or authorization. Identifiable portrait photographs will be used for public promotional purposes only when VBM has obtained the appropriate permission or release.

Specific copyright, licensing, model-release, and permitted-use terms may be governed separately by VBM’s applicable service agreement, license, or release.

Photo Editing and Processing

VBM may use third-party software, cloud-based platforms, artificial-intelligence-assisted tools, and other editing or processing services to prepare photographs and other media.

Media submitted to these services may be processed or stored by the applicable service provider as necessary to provide its services. Such providers may process information according to their respective privacy policies and terms.

The editing and processing services used by VBM may change over time.

Third-Party Service Providers

VBM uses third-party service providers to operate our websites and business and to provide services to clients.

These providers include or may include WordPress.com, HDPhotoHub, CloudSpot, Stripe, cloud-storage providers, email and communications providers, photo-editing and processing services, and other technology providers reasonably necessary to operate VBM’s business.

HDPhotoHub and CloudSpot may be used for functions including client management, inquiries, scheduling, orders, photography hosting and delivery, online galleries, communications, invoicing, and other photography-related services.

Information processed through these platforms may include names, email addresses, telephone numbers, property or photography-session information, photographs and other media, orders, communications, gallery or delivery activity, and other information necessary to provide VBM’s services.

These providers may collect, process, transmit, and store information on behalf of VBM in connection with providing their respective services. They may also process information as necessary to operate, maintain, secure, and improve their platforms or as otherwise permitted by their respective privacy policies and terms.

VBM does not sell or rent personal information to these service providers for their own independent marketing purposes.

Website Forms

Information submitted through forms on VBM websites may be transmitted to VBM by email and may also be stored by the website, hosting provider, CRM, or other service used to provide the form.

For example, forms provided through WordPress.com may retain submitted form responses in addition to sending a notification to VBM. Other platforms used by VBM, including HDPhotoHub and CloudSpot, may similarly retain information submitted through their respective systems.

Payment Processing

VBM may accept payment through credit or debit card, cash, check, electronic payment services, or other approved payment methods.

Online card payments made through services such as HDPhotoHub and CloudSpot are processed using Stripe-based payment processing. VBM does not directly collect or store complete credit or debit card numbers submitted through these systems.

VBM may also accept electronic payments through third-party payment services such as PayPal or Venmo. When a client chooses to use a third-party payment service, payment and account information may be collected and processed by that provider according to its own privacy policy and terms.

Payments made by cash or check are handled directly by VBM. VBM may maintain records documenting a payment, including the payment method, amount, date, and applicable transaction information.

Regardless of payment method, VBM may retain invoices, receipts, payment status, transaction records, and other records reasonably necessary for business, accounting, tax, legal, and recordkeeping purposes.

Such information may include a minor’s name, age, graduation year, school, photography-session information, or other information relevant to the requested services.

VBM’s websites are not intended to solicit children to independently provide personal information without the involvement or authorization of an appropriate adult.

Public use of identifiable portrait photographs of minors for VBM’s portfolio, advertising, website, social media, or other promotional purposes will be subject to appropriate permission or release requirements.

Property and Access Information

In connection with real estate photography and related services, clients may provide VBM with property addresses, homeowner or occupant information, lockbox instructions, access codes, alarm or entry instructions, property notes, or other information necessary to access or photograph a property.

This information may become part of the applicable job or order record and may be retained by VBM or the third-party platform used to manage the order.

Clients should provide only access information reasonably necessary to perform the requested services and should change or deactivate temporary access credentials when appropriate.

Disclosure of Information

VBM does not sell or rent personal information or provide client information to unrelated third parties for their own independent marketing purposes.

VBM may disclose or permit access to information when reasonably necessary:

  • To third-party service providers that process information or provide services on VBM’s behalf
  • To process payments or transactions
  • To perform or deliver requested photography or media services

Third-party providers used by VBM maintain their own security practices and are responsible for the security of information processed through their respective systems.

Access, Correction, and Deletion Requests

You may contact VBM to request access to, correction of, or deletion of personal information maintained by VBM.

VBM will consider and respond to reasonable requests as appropriate and as required by applicable law.

Deletion requests do not necessarily require VBM to destroy all records associated with a client or transaction. VBM may retain information when reasonably necessary for legitimate business purposes, contracts, transaction history, invoices, accounting or tax requirements, dispute resolution, fraud prevention, enforcement of agreements, legal obligations, or other lawful purposes.

Deletion from VBM’s active systems may also not immediately remove information from backups or third-party systems where retention is necessary or controlled by the applicable service provider.

Third-Party Websites and Services

VBM websites and communications may contain links to or integrate with third-party websites and services.

When you interact with a third-party website, platform, payment processor, gallery, or other service, that provider’s privacy policy and terms may also apply.

VBM does not control the independent privacy practices of third-party providers.
